Position Summary

Virgin Galactic is seeking an attorney with a strong background and experience in space-related U.S. trade sanctions, compliance implementation, and related investigations (EAR, ITAR, OFAC) to join its legal team. The attorney filling this position must be both qualified for and interested in assuming a visible and pivotal role in growing and shaping the company’s international trade compliance function.

This is an executive position reporting to and collaborating with General Counsel. This position will provide counsel and legal leadership to business management on export, import, and trade compliance matters - and help strategize the growth and enhancements required to best meet the needs of this growing global business.

 

Your Mission

  • Provide hands-on counsel on a broad range of US, EU, and other international export, import, trade law compliance, and internal/government compliance matters and help strategize the growth and enhancements required to best meet the needs of this growing global business.
  • Help strategize business-unit growth to meet the compliance needs of VG’s global operations.
  • Enhance company compliance by developing and implementing key global policies, procedures, controls, communications strategies, and employee training.
  • Communicate regularly with applicable governmental agencies regarding VG’s current and proposed operations.
  • Lead internal investigations and audits and negotiate resolutions with appropriate federal agencies in instances of non-compliance.
  • Deal with diverse constituencies and external parties (board members, investors, other stakeholders, regulators, external counsel, politicians, customers & clients, and other business leaders.
  • Supervise other export control professionals as assigned in day-to-day compliance, transactional planning, and enforcement related activities.
  • Assume project leadership role in compliance initiatives by providing direction to other departments and leading cross-functional teams.
  • Supervise outside counsel as necessary.
  • Prepare required reports and necessary government filings, including annual reports, license applications, and Technical Assistance Agreements.
  • Develop, direct, motivate, and drive performance from the compliance team.
  • Anticipate issues, strategically assess risks, and identify proactive solutions that will eliminate or mitigate risks.
  • Base your decision-making process on ethics and integrity.
  • Create associations of trust and respect with key stakeholders.
  • Keep abreast of legislative changes.

What you bring

  • Must be a U.S. Person as defined by the U.S. International Traffic in Arms Regulations (ITAR) and eligible for a U.S. government security clearance.
  • Approximately 10 or more years’ legal experience focusing on trade law, export and import compliance, and related investigations matters. Facility with ITAR, EAR, OFAC, FCPA, and other regulations pertaining to international trade is most important.
  • Experience working with US government agencies responsible for the review of trade compliance, including the Department of State, the Department of Commerce, the Department of Homeland Security, and the Defense Technology Security Administration.
  • Skilled in leading investigations / audits and winning the confidence of business management.
  • Ability to manage multiple requirements and remain composed under pressure.
  • Experience in managing projects and supervising personnel in these efforts.
  • Strong interpersonal and communications skills that will cause the attorney’s counsel to be sought and followed.
  • A pro-active and energetic approach that ensures that the corporation’s business and legal risks are being anticipated and responded to effectively.
  • Familiarity with FAA Regulations Part 400 preferred.
  • Ability to serve as an Empowered Official.
  • Professional maturity and impeccable ethics and integrity.
  • Business orientation and a strong interest in working as part of a space-technology driven business/manufacturing environment.
  • Must be a degreed and licensed attorney eligible to practice in the applicable jurisdiction(s).
  • Ability to travel. Travel is estimated at about 50% and may include international travel.

ITAR Requirements

To conform to U.S. Government space technology export regulations, applicant must be a U.S. citizen, lawful permanent resident of the U.S., protected individual as defined by ITAR (22 CFR §120.15), or eligible to obtain the required authorizations from the U.S. Department of State.
